Sozoku Toki made Mandatory in Japan from April 1, 2024
Introduction
Happy New Year! As it is the new year, it is good to reflect upon a new rule that was enforced in Japan this past year in 2024 that touches on inheritance law in Japan.

Sozoku Toki refers to the change of title in real estate that is legally made from a deceased to his/her heir after the death of the deceased, with respect to any real estate that the deceased owned during his/her lifetime. Although in prior times, the process of legally changing title to an heir after the real estate owner’s death was not required, this process was made mandatory in Japan beginning April 1, 2024.
 
Main Points to Know About the New Rule
The following include main points to know about this new rule:
  • This new rule will be enforced beginning April 1, 2024.
  • A penalty of less than 100,000 JPY shall incur if the heir fails to record the change in title within 3 years of learning that he/she had succeeded to the real estate.
  • Real estate that an heir had succeeded from the deceased, even prior to April 1, 2024, will also be subjected to this new rule.
 
How to Report a Change of Title under this New Rule
Under the new aforementioned rule, upon the death of a real estate owner, such as a father, for example, where the father’s first son is determined to be the heir to succeed to said real estate, the first son will need to register for a transfer of title by succession at the Legal Affairs Bureau in Japan.
 
Main Purpose of the New Rule
The main purpose of this new rule is to prevent unclear title on land ownership in Japan, as much as possible.
 
Conclusion
It is good to understand the new rule so that you will be able to succeed to title to real estate properly in Japan after a loved one’s death, and to avoid any penalties for failing to comply with the new law.

Meet Yuka Hongo, Esq.
Yuka Hongo is a respected estate planning attorney based in Honolulu, Hawaii. She has practiced law for 10 years and is fluent in both English and Japanese.
 
Practice Areas: Yuka represents clients in matters related to estate planning such as the preparation of trusts, wills, and Transfer on Death Deeds. She also provides a service in the area of estate administration, including probate.

Education: In 2000, Yuka graduated from Oberlin College (Oberlin, OH), where she earned a Bachelor of Arts Degree in Economics and East Asian Studies. In 2004, she graduated from Loyola Law School (Los Angeles, CA), where she earned her Juris Doctor Degree. In 2022, Yuka graduated from Keio University (Tokyo, Japan) where she earned a Master of Laws Degree.
